1. Agreement to Terms
These Terms of Service constitute a legally binding agreement between you (whether individually or representing an enterprise) and Smart Work Point Pty Ltd (referred to as "Smart Work Point", "we", "us", or "our"), governing your access to our website (smartworkpoint.click), participation in our laboratory training workshops, booking of technical advisory consultations, and commissioning of on-site facility feasibility audits.
2. Nature of Services Provided
Smart Work Point provides technical education, practical electronic hardware diagnostic training, and physical facility engineering evaluations relating to computing hardware, power distribution, and thermal airflow management. All training is educational in nature. We provide practical instructions on handling electrical components, micro-soldering, and thermal design.
3. Workshop Enrollment & Laboratory Safety Rules
Participation in our physical laboratory workshops at 42 Church Road, Seaton VIC 3858 requires strict adherence to workplace health and safety (WHS) protocols:
- Personal Protective Equipment (PPE): Participants must wear enclosed footwear, protective eyewear, and ESD grounding straps provided at the workstation when operating soldering equipment or live test benches.
- Fume Extraction & Ventilation: Soldering irons and hot-air rework stations must only be operated with active fume extraction hoods turned on.
- High Voltage Safety: Participants must follow instructor directions before energizing any 3-phase switchboard, load bank, or current-limited DC power supply.
- Right of Removal: Smart Work Point reserves the right to immediately dismiss any participant whose behaviour creates a direct electrical or physical hazard to themselves or other attendees, without entitlement to refund.
4. Intellectual Property Rights
All printed laboratory course manuals, schematic diagrams, signal tracing guides, test fixture software scripts, website copy, and proprietary curriculum materials provided during workshops remain the intellectual property of Smart Work Point Pty Ltd. Enrolled participants receive a personal, non-transferable licence to use printed field manuals and provided scripts for their internal business operations and personal diagnostic work. Redistribution, commercial resale, or public online publication of our workshop manuals without prior written authorization is strictly prohibited.
5. On-Site Facility Engineering Audits
Where an on-site feasibility audit is commissioned, Smart Work Point engineers conduct visual, acoustic, and thermal inspections of power switchboards, cable runs, and ventilation pathways. Our written engineering reports provide recommendations based on industry best practices and observed conditions. Physical electrical wiring, switchboard modifications, and transformer installations must be carried out by a licensed master electrician in accordance with Australian Standards (AS/NZS 3000).
6. Limitation of Liability
To the maximum extent permitted by Australian Consumer Law, Smart Work Point Pty Ltd, its directors, employees, and contractors shall not be liable for any indirect, incidental, special, or consequential damages resulting from your hardware repair attempts, equipment modifications, firmware flashing, or facility electrical reconfigurations. While our training teaches component-level diagnostic procedures, the handling of delicate semiconductor components carries inherent operational risks.
7. Informational Pricing
All prices displayed on smartworkpoint.click are in Australian Dollars (AUD) and are informational. Formal quotes and invoices are issued upon confirmation of workshop seat availability or agreed audit scope.
8. Governing Law & Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in Victoria, Australia.
